Terms of Service

These terms set out how we work together: what you can expect from King Landscaping and Maintenance, what we need from you, and what happens when something does not go to plan. They apply when you book an assessment with us, accept a quote, or use this website. Please read them — particularly section 07 on plants and lawns, because living things behave differently from building materials and we would rather you knew that up front.

01About these terms

This website and the services described on it are provided by King Landscaping and Maintenance (“King Landscaping”, “we”, “us”), operating in Nassau, Bahamas.

By booking an assessment, accepting a quote, or allowing us to carry out work, you agree to these terms. If you are booking on behalf of a company, a landlord, a strata or anyone else, you confirm you are authorised to agree to them on their behalf.

Where we have signed a separate written contract with you — a commercial maintenance agreement, for example — that contract takes priority over these terms wherever the two disagree.

02Our services and where we work

We provide landscaping, lawn maintenance, weed control, lawn and plant treatment, fertilization and grass restoration, irrigation installation and repair, tree cutting and pruning, problem-yard diagnosis, landscape restoration, commercial grounds maintenance, and plants grown at our own nursery, which also sells to the public.

We work in Nassau, Bahamas, including Paradise Island, for residential and commercial clients. If the property is further out, ask — we will tell you honestly whether we can reach you.

We may decline any job. Usually that is because it falls outside what we do well, because it would not be safe, or because we do not believe the result would be worth what it would cost you. We would rather say no than do a job badly.

03Assessments and quotes

The on-site assessment is free and carries no obligation. We come to the property, look at it properly, measure up and talk through what you want.

  • We quote after seeing the property, not over the phone. A number given down the phone is a guess.
  • Quotes are given in writing and are valid for 30 days unless the quote itself says otherwise. After that, material and plant prices may have moved.
  • A quote covers only the work it describes. Anything else is a separate job and a separate price.
  • A quote is based on the conditions we could see on the day. If work begins and we find something that was not visible — rock under the topsoil, a buried structure, root damage, a pest problem, drainage that fails only in heavy rain — we will stop, tell you what we have found, and agree the change with you before carrying on. See section 10.

Please have whoever can make decisions about the property present at the assessment. It saves a second visit and gets you the quote faster.

04Booking, rescheduling and cancellations

Assessments are booked through the calendar on this website, or by arrangement with us. You will get a confirmation, and a reminder before the visit.

  • To reschedule or cancel, please give us as much notice as you can — ideally 24 hours. A quick message costs you nothing and saves us a wasted trip across the island.
  • If nobody is at the property when we arrive for a scheduled assessment and we have not heard from you, we will treat the appointment as cancelled and you are welcome to book another.
  • If we need to move an appointment — because of weather, a vehicle problem or an overrunning job — we will contact you as early as we can and offer the next available time.
  • For booked work (rather than an assessment), cancellation terms are set out in your quote or agreement. Where plants, materials or equipment have already been bought or hired for your job, those costs are payable.

05Access to the property and what we need from you

So that we can do the work safely and properly, you agree to:

  • Confirm you are entitled to have the work done — that you own the property, or have the owner's permission. If a neighbour, landlord, strata or association needs to approve the work, that approval is yours to obtain.
  • Give us safe access on the agreed day, including gates, side access and any keys or codes needed.
  • Secure pets and keep children away from the working area. Mowers, blowers, chainsaws and chippers are dangerous, and we will stop working if it is not safe to continue.
  • Move what you do not want moved by us — garden furniture, ornaments, toys, vehicles, and anything fragile or valuable.
  • Tell us about anything hidden — see section 06.
  • Point out plants that matter to you. If a plant has sentimental value or you want it kept, tell us before we start. We cannot know that by looking at it.

Where you have asked us to work while you are out, you accept that we will proceed on the basis of what we agreed, and we will leave a note of what was done.

06Underground and hidden services

Landscaping means digging, and digging means risk. Before any work that breaks ground — planting, irrigation, tree removal, regrading — you must tell us about anything under or behind the surface that you know of or ought reasonably to know of. That includes:

  • Irrigation lines and sprinkler heads
  • Water pipes, cisterns and wells
  • Electrical cables, low-voltage garden lighting and pool wiring
  • Septic tanks, soakaways and drainage fields
  • Telephone, internet and cable television lines
  • Pool plumbing, foundations, footings and buried structures

We take reasonable care and we know what to look for. But we cannot be held responsible for damage to anything buried that you did not tell us about and that was not reasonably visible, and any cost of repairing it is yours. Where the position of something is uncertain, we will say so before we dig, and we may ask you to have it located first.

07Plants, lawns and trees are living things

This is the part most people skip, so we will keep it short and honest.

We choose plants for your soil, your light, your exposure and your season, and we plant them at the right depth, at the right spacing, at the right time of year. That is precisely what we are good at, and it is the single biggest reason our work lasts. But a plant is a living thing, and nobody can guarantee that a living thing will survive.

After we have planted, how a plant does depends heavily on things outside our control: watering, weather, storms, salt spray, drought, pests, disease, pets, and anything else that happens on the property.

  • We will tell you exactly how to look after what we have planted, and we will put it in writing if you want it.
  • Watering is the client's responsibility once we leave, unless you have engaged us on a maintenance schedule that includes it.
  • We do not offer a survival guarantee on plants, and we would be cautious of anyone who did. What we stand behind is that the plant was the right choice for the site and that it went into the ground correctly.

If something we planted fails, tell us. We will come and look at it and tell you straight why it happened — and if it was our doing, we will put it right.

08Tree cutting and pruning

Trees get cut when they should be cut, the way they should be cut. Sometimes the right professional answer is that a tree should not be cut yet, or at all, and we will tell you so even though it costs us the job.

  • You are responsible for obtaining any permission or permit required for tree work, and for confirming that the tree is on your property.
  • Where a tree overhangs or sits near a boundary, it is your responsibility to deal with your neighbour before we start.
  • Removal of stumps, roots and arisings is only included where the quote says so.
  • We will not carry out work we consider unsafe, or work that would in our professional judgement kill or seriously damage a healthy tree.

09Weather, season and delays

We work outdoors in the Bahamas, and the weather decides more than we do. Heavy rain, storms, high winds and the hurricane season can make work unsafe, or can make it pointless — there is no sense planting into ground that is about to be flooded.

Where weather, a supplier, a shipment, an equipment failure or anything else outside our reasonable control causes a delay, we will tell you as soon as we know, and we will reschedule at the earliest sensible opportunity. We are not liable for loss caused by a delay of that kind, and timescales given in a quote are estimates given in good faith rather than guarantees.

10Changes to the work

If you want something added or changed after work has started, tell us and we will price it. Nothing extra gets done, and nothing extra gets charged, without your agreement.

If we find a condition that was genuinely not visible at the assessment and that changes the job, we will stop, explain what we have found, and give you the choice: agree the revised price, reduce the scope, or stop there and pay only for the work already done.

11Pricing and payment

Prices are quoted in Bahamian dollars and include the cost of labour, plants and materials as described in the quote.

  • For larger installation and restoration jobs we normally ask for a deposit before work starts, so that plants and materials can be bought. The amount will be stated on your quote.
  • The balance is due on completion, unless your quote or agreement sets out different terms.
  • Ongoing maintenance is invoiced on the cycle set out in your agreement.
  • Plants and materials we have supplied remain our property until they are paid for in full.
  • Where an invoice remains unpaid past its due date, we may suspend further work and recover reasonable costs of collection.

If you are unhappy with something, tell us before the invoice is due rather than after. We would far rather come back and fix it.

12Photographs of completed work

We photograph our work — before, during and after — to keep a record of the job and to show the standard of our work to future clients on our website and social media.

These photographs show the landscaping only. We do not publish your name, your address, or anything that identifies where the property is, and we do not photograph people without asking. If you would prefer we did not use photographs of your property at all, tell us at any time and we will not — before or after the fact. There is no penalty and it makes no difference to your price.

13Our liability

We carry out our work with the skill and care you would expect from an experienced landscaping business, and we take responsibility when we get something wrong.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud, or for anything else that cannot lawfully be limited.

Subject to that:

  • Our total liability in connection with any job is limited to the amount you paid us for that job.
  • We are not liable for indirect or consequential loss — for example lost income, lost rental, or loss of business.
  • We are not liable for pre-existing defects in the property, for damage caused by conditions we were not told about, or for work carried out by anyone else.
  • We do not guarantee the survival of plants once they are in the ground and in your care — see section 07.

If we damage something of yours through our own carelessness, tell us straight away and we will deal with it properly.

14Text messages and email

When you give us your phone number or email address, you agree that we may contact you about your enquiry, your appointment and your job — by phone, text message and email.

Reply STOP to any text to stop receiving them, or use the unsubscribe link in any marketing email. Message and data rates from your mobile provider may apply. How we handle your contact details is set out in our Privacy Policy.

15Use of this website

The content of this website — text, photographs, the King Landscaping name and logo — belongs to us and may not be copied or reused without our written permission.

The information here is provided in good faith and describes our services generally. It is not specific advice about your property; that is what the assessment is for. We do not warrant that this site will always be available or free of errors.

You agree not to misuse this site, attempt to interfere with it, or use it for any unlawful purpose.

16Privacy

How we collect, use, store and delete your personal information — including information you give us through a Facebook or Instagram lead form — is explained in full in our Privacy Policy, which forms part of these terms.

17Governing law

These terms, and any dispute arising out of them or out of work we carry out for you, are governed by the laws of the Commonwealth of The Bahamas, and the courts of The Bahamas have exclusive jurisdiction.

If any part of these terms is found to be unenforceable, the rest continues to apply.

Before anyone goes near a court, please talk to us. In more than twenty years, almost everything has been sorted out with a conversation and a return visit.

18Changes to these terms

We may update these terms from time to time. The version that applies to your job is the version published on the date you accepted your quote. The date at the top of this page shows when it was last revised.
